Can HOAs Legally Deny Solar Panels in Florida?

So, the answer to the question is no. In Florida, HOAs cannot prevent homeowners from installing solar panels, but there are some stipulations. Florida law does grant HOAs leeway when it comes to imposing reasonable regulations when it comes to the placement, size, and appearance of solar panels. It is important to note that these regulations imposed by the HOA cannot impair the solar system’s efficiency.

The Florida Solar Rights Act (FSRA)

The Florida Solar Rights Act, under Florida Statute 163.04, outlines the law as it pertains to Florida Homeowners Associations and the restrictions that they can put in place to restrict solar panel installations across the Sunshine State.

In this statute, the law explicitly prohibits HOAs as well as local governments from enacting rules that prohibit homeowners from the installation of solar systems.

What HOAs Cannot Do

Per the FSRA, HOAs in Florida are not permitted to block homeowners from installing solar panels within their communities. Further, they cannot impose rules that could hinder the solar system’s performance.

This includes rules to avoid:

  • Reduction of energy output: This means that HOAs cannot require homeowners to place solar panels in shady areas.
  • Increased costs: The installation should not be exorbitantly more expensive. For example, HOAs cannot demand custom-colored panels.
  • Impractical Installations: HOAs cannot mandate homeowners to replace their roofs when the existing roof is structurally sound for the installation of solar.
